Filing a DMCA Notice of Alleged Infringement

Counter-Notification

If you believe that your material that was removed (or to which access was disabled) is not infringing, or if you believe that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our DMCA Agent:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your judicial district, or if your address is outside the United States, for any judicial district in which Xpadder.app may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the original complaining party does not file a lawsuit within 10 business days, we may restore the removed content.

Repeat Infringers

In accordance with the DMCA and other applicable laws, Xpadder.app has adopted a policy of terminating, in appropriate circumstances and at Xpadder.app’s sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to Xpadder.app and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
